ABSTRACT: While introducing, as Dean of the Faculty of Law, the presentation of the Studies in Honour
of Mario Romano, are outlined the academic career as criminal law professor for over forty years and
some remarkable scholarly as well as personal traits of the honoured, which contributed to the overall
enrichment he has brought to the university life and to the work of many fellow scholars. A special
mention deserves how he has always been ready to help young researchers in their lives and careers
and his cherishing an ideal of humanism, to be meant as eagerness to ever preserve the patience and
the time needed for thought and personal conscience.

ABSTRACT: This paper deals with the extension and the extraordinary scientifi c value of the works written
by a great Master in Criminal Law, such as Mario Romano. The Author briefl y presents some of
the most relevant contributions given by professor Mario Romano to the Criminal Science, fi rst of
all his Commentario sistematico del codice penale (Systematic commentary on the penal code), a
unique work. Finally, the paper talks about some topics which have been developed inside the work
Scritti in onore di Mario Romano (Writings in Honour of Mario Romano).

ABSTRACT: The paper presents, also in the light of the personal relationship, the personality of professor
Mario Romano, as scholar and teacher, who left the university tenured teaching as a professor of
Criminal Law at the Università Cattolica del Sacro Cuore in Milan. Among the others, also emerge
considerations about the research method in criminal law and punishment.

ABSTRACT: After describing the personality of the scholar, we can identify the essential characters of
his scientifi c thought. Freed from metaphysical elements, criminal law is legitimated, and it should
always be based, upon social consensus. Another fundamental basis is the centrality of the human
being both as the individual engaging in a criminal conduct and the protected victim of a crime.

ABSTRACT: The work analyses the most relevant – and still current – contents of Mario Romano’s monograph
entitled Profi li penalistici del confl itto di interesse dell’amministratore di società per azioni
(Penal features of the confl ict of interest of joint-stock companies’ managing directors), emphasizing
the validity of the solutions advanced by the Author as far as the general crime theory is concerned.

ABSTRACT: The complex nature of the contemporary western societies, characterized by the strict interlacing
between economic and technological factors, puts in question some «classical» legal categories
and, at the same time, their conceptual horizons (for instance the notions of «legal order» and
«system»). Hence, using the «globalization» as a case-study, you can read these new sceneries by a
new theoretical perspective and, more precisely, a «reticular model». It is based on the interpretation
of the social contexts by the concept of «net» (network society or web society), which is essentially
«atopical», «horizontal», «ahierarchical», «aformal» and «self-increasing». Consequently, it’s possible
to interpret the political-legal «subjects» and institutions as «knots», which are fundamentally:
«functional» (instrumental), «neutral», «polar», and «replaceable». From a philosophical-legal point
of view, this new conceptual scheme is to be understood in a postmodern horizon, for which the traditional
categories of «totality» and «generalization» make room, in some way, to the new horizon
of «effectivity».
Abstract: Compared to the chaotic irrationality of guilt, retribution aims to be reason itself, measure,
order (cosmos). But – as I try to show in this paper – if retribution claims to be essentially rational,
it is not necessarily intelligent, and that for three reasons at least. First, because of the radical impossibility
of measuring guilt. Second, because a sanction cannot restore the order cancelling the disorder
produced by guilt. Third, because the other order of human relations paradoxically requires a certain
disorder.

Abstract: There are many different conceptions of human in genetics: human could be considered as an
object, a social enhancement plan or a social consumer plan. The lack of a shared model calls for a
meditation over transitional mankind. The continuous modifi cation allows us to recognize humanity
in the difference between a rational image of self and what (or who) this icon creates. This is the
motionless point between self-construction and self-transcending, both endless.

ABSTRACT: In this paper is analysed the volume of Amartya Sen The Idea of Justice. Here are considered
and discussed the methodological foundations and the goals proposed by Sen, establishing a conception
of justice that must actually emerge in a society through the public debate, and the implications
above all terms of reduction of the most resounding injustices, still existing in many societies. In this
analysis one gives evidence to the conceptual ancestors probably in contradiction in the Utilitarianism
of Jeremy Bentham and John Stuart Mill, and some theoretical diffi culties that seem emerge in the
Senian elaboration.

ABSTRACT: In international law, there is no such thing as an offi cially accepted defi nition of a national
minority. The lack of a clear defi nition not only refl ects the well-known combination of objective
criteria to decide what national minorities are, but also it is dependent on the subjective will by the
minorities themselves to be recognized as such. In order to understand these problems of defi nition,
the present article attempts to draw a large picture of their historical legal protection by considering
that each national minority identity has its own genetic character in the different modern state
nation-building policies.

ABSTRACT: Willem Van Rossum took part in the proceedings of Canon Law codifi cation of 1917, as a
member of the Commission of Consultores and of the Cardinal’s Commission, and he was chosen to
represent the Dutch episcopate. As Consultor, thanks to his theological competence, ha was commissioned
by Mons. Gasparri to prepare four Vota about confi rmation, extreme unction and marriage;
in them, he preserved as much as possible the traditional Church’s doctrine, as demonstrated by the
Archivio Segreto Vaticano documents consultation. Many of the proposed canons were included in the
Codex Juris Canonici 1917.
