This study is about the dichotomy between the individual rights and the State law, from a constitutional point of view. The idea is to show the main constitutional issues concerning the recognition of rights. The article draws attention to the danger of considering the State as something that merely converts individual desires into rights, and invites to rethink the role of the law as an instrument to defend the human dignity for the common good.
