The paper deals with fundamental issues concerning liability for autonomous systems. The analysis considers the current rules in European jurisdictions – in particular the structures and categories of fault-based liability, strict liability and product liability – and investigates the extent to which legal innovation is required to cope with the new challenges of technological progress. In this context the Author discusses the initiatives developed by the European Union to regulate automation, namely the proposals for directives on artificial intelligence liability and on liability for defective products, as well as the Artificial Intelligence Act, adopted in May 2024. Finally, the essay goes
