This article examines the problems of French embassy in Holy See, after the entrance of
Italy in Second World War. Are analyzed in particular the proposals of French diplomacy to give
international guarantees for Holy See freedom. These indications are developed by Jacques Maritain,
French ambassador in Vatican from 1945 to 1948, to reform Lateran Treaty, and give to the
Holy See a really international statute. The «Maritain Project» has been definitely surpassed by article
7 of Italian Constitution of 1948, that reminds to Lateran Pacts.

The purpose of this essay is to investigate, in Sections 1 and 2, about the interpretation (with contributions from Graziani’s, Guerzoni’s and Caputo’s works) and application of the Lateran Concordat art. 1 about the special character of Rome until 1965 (particular focus on the Friendship Treaty signed by Italy and USA in 1948; the Mosque building in Rome). On Section 3 we’ll analize the «Vicario» affair (a play by Rolf Hochhuth). Section 4 has been devoted to the genesis of art. 2.4 from the new Concordat of 1984 (about the «particular meaning» of Rome). Section 5 focuses on the interpretation and application of the «particular meaning» of Rome (particularly the Great Jubilee of 2000 and the «World Gay Pride» meeting held in Rome). An appendix collects the main historical unpublished documents.

This arcticle examinates the interpretation and enforcement of arct. §1 of the Lateran
Concordat between the years from 1929 until the end of the Second World War. After a short
foreword, Section 2 describes the genesis of this disposition, and its own interpretation by the
Italian Government and the Holy See. Section 3 is about the interpretation of arct. par. 1 (particularly, it deals with Giacchi's, Schiappoli's, Falco's works). Section 4 describes the rule enforcement until 1940, and focuses on Hitler's visit to Rome in 1938. Section 5 analyses the 'sacred
character' of Rome as intended by the French point of view expressed by their diplomatical papers issued during the Second World War. Sections 6 and 7 analyse the links between the arct.
par. 1 of the Lateran Concordat, the Rome bombing by the Allies, and finally the declaration of
Rome as «open city».
